Terms of Service & Refund Policy

These Terms of Service ("Terms") are a legal agreement between you and Merchant Intel ("Merchant Intel," "we," "us," or "our"), operated by Merchant Intel LLC, governing your use of merchantintel.ai and our tools, content, and services (the "Services"). By using the Services or purchasing from us, you agree to these Terms.

Not professional advice. Merchant Intel provides general information and independent analysis about the payment-processing industry. It is not financial, legal, tax, or accounting advice, and it does not create a professional-client relationship. Rate figures and examples are illustrative. You are responsible for your own business decisions.

1. Who We Are

Merchant Intel is an independent resource and service provider. We do not sell payment processing and are not a bank or processor. Our role is to inform and represent merchants.

2. The Services

We offer free content and tools (such as our newsletter and effective-rate calculator) and paid services, which may include:

Rate Review — analysis of your merchant statement and effective rate.
PCI Compliance assistance — help completing and maintaining PCI DSS requirements.
Rate Shopping — soliciting and comparing processor offers on your behalf.

We may add, change, or discontinue Services at any time. Descriptions and prices on the Site are subject to change.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services, and you must use them for lawful business purposes only.

4. Purchases, Pricing & Payment

Prices are listed in U.S. dollars and are shown on the Site (currently $59 Rate Review, $99 PCI Compliance, $79 Rate Shopping) unless otherwise stated.
Payments are processed securely by Square. By purchasing, you authorize us (through Square) to charge your selected payment method for the amount shown.
You agree to provide accurate purchase information and confirm you are authorized to use the payment method.

5. Refund Policy & Money-Back Guarantee

Because our paid services are delivered digitally and involve our time and analysis, the following applies in place of a traditional product return:

Savings Guarantee. For eligible services, if we do not identify potential annual savings greater than the fee you paid for that service, we will refund that fee. To claim, email info@merchantintel.ai within 60 days of your purchase; we may ask for reasonable documentation (such as your current merchant statement) to evaluate the claim.
Satisfaction window. If we have not yet begun work on your service, you may request a full refund within 14 days of purchase by emailing info@merchantintel.ai.
After work has been delivered, fees are non-refundable except as provided by the Savings Guarantee above or as required by law.
Approved refunds are issued to your original payment method through Square and may take several business days to appear.

The Savings Guarantee reflects potential savings we identify; it is not a guarantee that any processor will offer a given rate or that you will realize any specific dollar amount.

6. Acceptable Use

You agree not to misuse the Services, including by: violating any law; infringing others' rights; attempting to disrupt or gain unauthorized access to the Site; scraping or copying content without permission; or using the Services to send spam or malicious content.

7. Intellectual Property

The Site, its content, branding, and tools are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Site for its intended purpose. You may not reproduce or redistribute our content without permission.

8. Third-Party Services & Links

The Services rely on and may link to third parties (such as Square, MailerLite, Netlify, and processors we compare). We are not responsible for third-party services, offers, or content, and your use of them is subject to their terms.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that any result or savings will be achieved.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MERCHANT INTEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Merchant Intel from claims, damages, and expenses arising out of your misuse of the Services or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Alabama, and you consent to their jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted, and continued use of the Services means you accept the updated Terms.
